Welcome to RAMO USA LLC. These Terms of Service ("Terms", "Agreement") govern your relationship with and use of the website https://www.ramousa.org/ (the "Website"), and your purchase and participation in any bike tours or purchase of any electric bikes (e-bikes) offered by RAMO USA LLC ("RAMO", "we", "us", or "our").

Please read these Terms carefully before booking a tour or purchasing a product. By accessing the Website, booking a tour, or purchasing a product, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access our services or purchase our products.

Note on Jurisdiction: While our administrative address is located in New Jersey, our operations, bike tours, and physical services are primarily executed within the State of New York. These Terms are drafted in compliance with local New York State and New York City consumer laws.

2. BIKE TOUR SERVICES

We offer four (4) distinct guided and/or self-guided bike tour experiences in New York City:

  1. Times Square Zone 1

  2. Times Square Zone 2

  3. Central Park

  4. Central Park + Times Square Zone 2

2.1 Booking Window & Payment

  • Advance Booking: To guarantee logistics, vehicle/bicycle availability, and guide scheduling, payments and reservations must be completed at least twenty-four (24) hours (1 day) and no more than one (1) week (7 days) in advance of the scheduled tour date.

  • Logistics Commitment: RAMO rents and reserves third-party equipment, vehicles, and guides immediately upon receiving your payment to secure your slot.

2.2 Cancellation, Rescheduling, and Refund Policy

Because we pre-arrange and commit financial resources for vehicle rentals and tour guides immediately upon your booking, we enforce a strict refund and cancellation policy:

  • Standard Non-Refundability: All bookings are generally non-refundable unless cancelled in accordance with the 24-hour notice policy below.

  • 24-Hour Notice Rule:

    • Cancellation with Refund/Reschedule: If you notify us at least twenty-four (24) hours prior to your scheduled tour start time, you may request a full refund or reschedule your tour to a later available date.

    • Late Cancellation & No-Show: If you cancel less than 24 hours before the tour start time, fail to request a rescheduling at least 24 hours in advance, or do not show up for your scheduled tour ("No-Show"), the service will be deemed fully rendered. No refunds, credits, or reschedules will be provided under these circumstances.

2.3 Physical Condition and Safety Requirements

  • Participants must be in good physical health and possess the necessary skills to safely ride a bicycle in an urban environment.

  • Age Restrictions: Participants under eighteen (18) years of age must be accompanied by a parent or legal guardian.

  • Helmets: Helmets are provided and are highly recommended for all participants. Under New York State law, helmets are mandatory for riders under the age of 14, and for all working cyclists/delivery workers. RAMO strongly encourages all riders, regardless of age, to wear a helmet at all times during the tour.

3. ASSUMPTION OF RISK, RELEASE, AND WAIVER OF LIABILITY

By booking and participating in a RAMO bike tour, you acknowledge and agree to the following waiver:

  • Inherent Risks: You understand that riding a bicycle in New York City (including Times Square and Central Park) involves inherent risks, including but not limited to traffic accidents, collision with pedestrians or obstacles, uneven road surfaces, weather conditions, and physical exertion.

  • Assumption of Risk: You voluntarily assume all risks, both known and unknown, associated with your participation in the tour.

  • Waiver of Liability: To the maximum extent permitted by New York State law, you hereby release, waive, and forever discharge RAMO USA LLC, its officers, employees, agents, and contractors from any and all liability, claims, demands, or causes of action arising out of negligence, personal injury, death, property damage, or loss suffered during or in connection with the tour.

4. ELECTRIC BIKE (E-BIKE) SALES

RAMO USA LLC offers electric bikes ("e-bikes") for sale. All e-bike sales are subject to federal, state, and local laws.

4.1 Safety Standards & NY Compliance

  • UL Certification: In strict compliance with New York City Local Law 39 of 2023 and other applicable New York State standards, all electric bikes and mobility devices sold by RAMO utilize electrical systems (including batteries, chargers, and drive trains) that are certified by an accredited testing laboratory to meet recognized safety standards (such as UL 2849 or UL 2271).

  • User Responsibility: Buyers are solely responsible for operating and storing their purchased e-bikes in accordance with local regulations, including New York City Fire Department (FDNY) guidelines regarding lithium-ion battery charging and storage.

4.2 Return and Refund Policy for E-Bike Sales

  • Return Window: Except as otherwise required by New York consumer protection laws, all e-bike sales are final unless a defect is reported within thirty (30) days of purchase.

  • Manufacturer Warranty: E-bikes may come with limited manufacturer warranties. RAMO will assist customers in processing warranty claims with the manufacturer where applicable, but RAMO itself provides no additional warranties beyond those implied by New York State law.

5. GENERAL TERMS & CUSTOMER CONDUCT

  • Compliance with Laws: You agree to obey all local traffic laws, signals, and directions given by RAMO tour guides or local law enforcement during the tours.

  • Damage to Equipment: If you damage a rented bicycle or tour vehicle through reckless behavior, negligence, or failure to follow instructions, you agree to be held financially responsible for the repair or replacement costs of the equipment.

  • Termination of Service: We reserve the right to refuse service, cancel bookings, or remove any participant from a tour, without refund, if their behavior is deemed unsafe, disruptive, or abusive to our staff, guides, or other participants.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, in no event shall RAMO USA LLC, its affiliates, directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the services; (ii) any conduct or content of any third party on the services; or (iii) any product purchased through us.

7. GOVERNING LAW & DISPUTE RESOLUTION

  • Governing Law: These Terms and any dispute arising out of or related to them, our tours, or our product sales shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
